Working with the pro se litigant normally, the pro se litigant is a member of your tribe or the tribe you work for. they are most often not familiar with the legal process. in many instances, english is not their first language. they often have less than a high school education and may be low income. for them, the legal process is frightening. they are very aware that their lack of knowledge about the legal process threatens their right to a fair resolution and to their property, and possibly, to their loved ones. at the same time, the pro se litigant faces possible financial hardships because of the costs involved in filing fees, service processing, and or potential monetary judgments. the typical pro se litigant is not just someone with an axe to grind. they are real people with real concerns. they are facing a system that they may not understand and they have to do it alone. in some instances though, you will see pro se litigants who receive legal advice from outside lay advocates. these lay advocates, if you will, could be their mother, neighbor, friend or a seasoned veteran of your tribes judicial system. in such cases, you must determine who that individual is. you must ask whether that person is a party, a potential witness, or if they are just there for moral support. you must explain to the litigant that they cannot be represented in the traditional sense ; by that person. in other words, you must inform them that he or she may not address the cour t on the pro se litigants behalf unless called as a witness or addressed by the judge. however frustrating that it may be, there is nothing to prevent the pro se litigant from seeking outside legal advice from these other sources. while our primary concern as clerks is to ensure that the litigant does not get legal advice from us, we may have to dispel misinformation about the legal process which the pro se litigant has gathered from these lay advocates. the angry and hostile pro se litigant is the hardest to manage. they often refuse to listen to you, even when they have asked you for information. they are so angry with the other party who brought them to court, or who they have brought to court, that often they do not hear your answer to their questions or demands. they blame you and the legal system for their problems and or lack of resolution. nothing happens fast enough or everything is happening too fast. the court is too much like the state or federal system or not enough like the state or federal system. they may threaten you, your job, and your tribes entire judicial system. how do you, as clerks, handle these litigants? the answer is, very carefully. you must make it clear to them that you cannot help them unless they listen to you. you must be firm in this effort. you may have to repeat this many times to the same litigant. do it! if they still insist on directing their anger toward you, if necessary, you must tell them that you will not assist them unless they stop venting at you or to come back when they are calmer and ready to listen. in some instances, you may have to have such litigants escorted out or forcefully removed from the court by security or tribal police. whatever happens, as a clerk, you must make sure that these litigants have access to your court. tell them that when they are ready to listen, you will give them the forms and information they need. the best way to manage this type of litigant is to spell out the rules of play, to be addressed later in this article.
